Copyright Infringement Notice

If you believe that your copyright-protected work has been posted on LiveWriters.com in a way that constitutes copyright infringement, please send us notice, including the information listed below, to our designated copyright agent:

Your notice must include substantially all of the following (you should consult with your legal counsel or see Section 512(c)(3) of the Copyright Act to confirm these requirements):

 

(i)  An electronic or physical signature of the owner, or the person authorized to act on behalf of the owner, of the copyright interest allegedly infringed.

 

(ii) A description of the copyrighted work that you believe has been infringed.

 

(iii) A description of where the allegedly infringing material is located on the LiveWriters website.  The best way to help us locate the content quickly is to provide a URL in the body of an email notification.

 

(iv) A way for us to contact you, such as: your address, telephone number, and/or email address.

 

(v) A written statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

 

(vi) A statement by you that the above information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

 

Please also note that under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

 

Counter-Notification

If we have removed your materials and you believe that the material has been wrongly removed, you may provide counter-notification claiming that the material does not infringe the copyrights of others.  We strongly recommend you consult with your legal representative and/or Section 512(g) of the Copyright Act before providing counter-notice.

 

A proper counter-notice must contain the following information:

 

(i)  Your name, address, phone number and physical or electronic signature;

 

(ii)  Identification of the material and its location on LiveWriters before it was removed;

 

(iii)  A statement under penalty of perjury that the material was removed by mistake or misidentification; and

 

(iv) Your consent to local federal court jurisdiction, or if overseas, to an appropriate judicial body to resolve the subject copyright disputes.

 

Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.  Please also be advised that we enforce a policy that provides for the termination in appropriate circumstances of subscribers who are repeat infringers.
